Careless Driving

If you’ve been charged with Careless Driving contrary to the Highway Traffic Act section 130, you are facing a possible insurance premium increase, 6 demerit points, a fine in the range of $400.00 to $2,000.00, or a possible imprisonment term of no longer than 6 months, or both. You can also face a driver’s licence suspension for a period of up to 2 years.

If you're a Commercial Motor Vehicle Driver and you've been charged with this offence, you can also face the above noted penalty, along with an additional 5 C.V.O.R. points against your C.V.O.R. abstract and the trucking company's abstract.

As a former Prosecutor, I noticed that this offence is used in a lot of cases where it doesn’t apply and yet still to this day, the trend continues.

If found guilty, this is an extremely serious offence and can affect you for years. Don’t take chances, hire someone to represent you to fight your ticket! This is one of the most serious offences found in the Highway Traffic Act.
